AVRS as a Non-Party to Allvoice v. Microsoft
Prior to the Declaration of Interference, Allvoice Developments, US LLC sued Microsoft Corp. in district court alleging infringement of Allvoice US Patent No. 5,799,273. On March 9, 2010, the Board of Patents Appeals and Interferences (BPAI) declared Interference between the Allvoice '273 patent and AVRS, Inc.. Many of the claims in Count 1 of the interference are also subject in the litigation.
On April 9, 2010 Allvoice served subpoenas on AVRS and its inventors. Likewise Microsoft served subpoenas on April 28, 2010. Oblon Spivak of Alexandria, VA (counsel for the Interference) represented AVRS filing a motion for protective order to limit the scope of discovery in the subpoenas.
Status of AVRS in Allvoice v. Microsoft
In December 2011 the Western District of Washington court granted in part and denied in part Microsofts motion for partial summary judgment. A copy of that opinion was filed with the BPAI.
